All materials, e.g., photography, video, floor plans and any other material provided by Realy1Media.com, is licensed for use in marketing related to the current sale of specific real estate properties. Media may not be reused in future sales. All media is owned and copyrighted by Realty1Media.com and cannot be used or distributed for any other purposes without written permission.

WARRANTIES

This Website is provided “as is,” with all faults, and Realty1Media.com, it’s owners, proprietors, licensors, directors, and photographers makes no express or implied representations or warranties, of any kind related to this Website or the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you.

BOOKING POLICY

We accept checks, and credit card payments via PayPal invoice. Final payments are due on delivery by invoice. We do not offer net terms. Final invoices are due immediately on receipt. An 8% late fee is assessed on accounts five (5) days past due.

CANCELLATION POLICY

We do not cancel a booking for any reason. We will be at your property to shoot as booked. However, once on-site all of our photographers reserve the right to reschedule due to inclimate weather as necessary. There are no fees to reschedule. If a reschedule is not possible, we provide a full refund less travel fees to and from the property.

LIMITATION OF LIABILITY

In no event shall Realty1Media.com, it’s owners, proprietors, licensors, directors, and photographers, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and Realty1Media.com including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

INDEMNIFICATION

You hereby indemnify to the fullest extent Realty1Media.com, it’s owners, proprietors, licensors, directors, and photographers, from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

ASSIGNMENT

However you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

GOVERNING LAW & JURISDICTION

These Terms will be governed by and construed in accordance with the laws of the State of Nevada, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Nevada for the resolution of any disputes.
